Privacy Policy
How ProWorx collects, uses, discloses, and protects information across our website, software platform, customer-facing tools, communications, payments, partner services, and AI-assisted features.

1. Scope of This Privacy Policy
Blackhawk Catalyst Technology & Consulting, LLC, doing business as ProWorx ("ProWorx," "we," "us," or "our"), provides software and related services for small service businesses. This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with the ProWorx websites, software platform, portals, customer-facing storefronts and microsites, intake and request forms, communications tools, AI-assisted tools, payment-enablement features, integrations, partner and referral features, support services, and related functionality (collectively, the "Service").
This Privacy Policy should be read together with our Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service where applicable.
2. Our Role When We Process Information
ProWorx processes information in more than one capacity. When a business customer provides or collects information through the Service about its own customers, prospective customers, employees, contractors, or other contacts, the ProWorx customer generally determines why that information is collected and how it is used. In those circumstances, ProWorx generally processes the information to provide the Service on the customer's behalf and under the customer's instructions, subject to our Terms of Service and applicable law.
ProWorx also determines certain purposes for processing information itself, including account administration, security, fraud prevention, legal compliance, product analytics, operation and improvement of the Service, advertising measurement, and the use of Operational Job Data described below. If you are an end customer of a business that uses ProWorx, that business may have its own privacy notice that also applies to your information.
3. Information We Collect
Depending on how you interact with the Service, we may collect the following categories of information:
- Account and contact information: name, business name, email address, telephone number, username, account identifiers, and similar contact or registration information.
- Business information: business type, service offerings, service areas, business address, licenses or qualifications voluntarily provided, pricing information, and information used to configure or support an account.
- End-customer and lead information: names, contact details, service addresses, requests, appointment information, photos, form submissions, estimates, invoices, service history, and other information submitted by or on behalf of a ProWorx customer's customers or prospective customers.
- Job and operational information: job type, scope, measurements, dimensions, quantities, materials and supplies, labor time, scheduling information, estimates, actual pricing, job status, completion information, ZIP code or similar generalized geographic information, and other operational characteristics of work managed through the Service.
- Communications and content: emails, text messages, support requests, notes, photos, files, attachments, reviews, feedback, and other content entered into or transmitted through the Service.
- Payment and transaction information: transaction amounts, invoice status, payment status, processor references, chargeback or dispute information, and other payment-related metadata. Full payment card numbers and bank-account credentials used for payment processing are handled through supported third-party payment services rather than stored by ProWorx as ordinary Customer Data.
- Device, log, and usage information: IP address, browser type, device type, operating system, pages or features viewed, dates and times of access, referring pages, approximate location derived from an IP address, account activity, error logs, and similar technical information.
- Cookies, pixels, and similar technologies: cookie identifiers, advertising or campaign identifiers, conversion events, page interactions, and related information used for authentication, security, analytics, performance measurement, and advertising measurement.
- Information from third parties: information we receive from payment processors, communications providers, integrations, referral or partner providers, identity or business-verification providers, advertising or measurement providers, and other services you choose to connect to or use with ProWorx.
4. How We Use Information
We may use information to:
- provide, operate, maintain, configure, and support the Service;
- create and administer accounts and authenticate users;
- process service requests, estimates, appointments, jobs, invoices, payments, reviews, and other workflows requested through the Service;
- deliver email, SMS, notifications, reminders, and other communications;
- provide customer support and respond to requests or inquiries;
- detect, investigate, prevent, and respond to fraud, abuse, security incidents, unauthorized access, prohibited conduct, or violations of our Terms of Service;
- operate, evaluate, troubleshoot, analyze, and improve the Service and develop new features;
- provide AI-assisted, automated, pricing, estimating, scheduling, routing, categorization, transcription, messaging, or similar features requested by users;
- measure website and marketing performance, including attribution and conversion measurement;
- facilitate requested payment, partner, referral, financing, insurance, group-purchasing, or other third-party services;
- comply with legal, regulatory, tax, payment-network, carrier, processor, and contractual obligations; and
- establish, exercise, or defend legal rights and enforce our agreements.
5. Operational Job Data and Product Development
ProWorx is designed to become more useful as it learns from real service-business operations. Consistent with our Terms of Service, we may analyze and use "Operational Job Data" across multiple customers to develop, train, test, validate, improve, and operate pricing models, estimating tools, material and purchasing recommendations, benchmarking tools, market insights, artificial-intelligence or machine-learning models, and other features of the Service.
Operational Job Data may include the nature and scope of work, job type, measurements and dimensions, materials and supplies, quantities, labor hours, duration, estimated or actual pricing, ZIP code or similar generalized geographic information, and other operational characteristics of a job, estimate, request, or service.
Operational Job Data does not include payment card numbers, bank-account information, private notes or private message content, street addresses, or end-customer names or contact information. ProWorx may process those categories for other legitimate purposes needed to provide the Service, but they are not part of the Operational Job Data used for cross-customer pricing, materials, purchasing, benchmarking, or generalized model development.
When ProWorx makes models, benchmarks, datasets, or insights derived from Operational Job Data available to other customers or third parties, we use reasonable measures to aggregate, de-identify, or otherwise avoid including information that directly identifies a specific end customer.
6. AI-Assisted and Automated Features
The Service may use artificial intelligence or automated systems to provide drafting assistance, intake support, pricing suggestions, job checklists or summaries, categorization, transcription, scheduling or route recommendations, messaging assistance, and similar functionality. Information you submit to an AI-assisted feature may be processed by ProWorx and by service providers that support the requested functionality.
Separate from the Operational Job Data rights described above, ProWorx does not use private notes or private message content as part of a generalized cross-customer pricing, purchasing, benchmarking, or model-training dataset. Users remain responsible for reviewing AI-assisted outputs as described in our Terms of Service.
7. How We Disclose Information
We may disclose information as reasonably necessary for the purposes described in this Privacy Policy and our Terms of Service, including to:
- Service providers: vendors that support hosting, infrastructure, data storage, communications, email, SMS, mapping, AI functionality, customer support, analytics, security, fraud prevention, and other functions performed for ProWorx.
- Payment processors and payment-related providers: when needed for payment processing, underwriting, identity or business verification, settlement, fraud prevention, disputes, compliance, or support.
- Partner Services and referral providers: when you request, authorize, or use a third-party offering, referral, quote, application, financing, insurance, group-purchasing, consulting, or other partner service.
- Advertising and measurement providers: for campaign attribution, analytics, conversion measurement, fraud prevention, and advertising effectiveness, as described below.
- Our customers and their Authorized Users: where information is collected or processed through an account or customer-facing ProWorx tool operated for that customer.
- Professional advisors and legal authorities: where reasonably necessary for legal, accounting, audit, insurance, compliance, regulatory, law-enforcement, dispute, or safety purposes.
- Business transaction recipients: in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, subject to applicable law.
We do not sell personal information for money. Certain disclosures involving advertising or measurement technologies may nevertheless be treated as a "sale," "sharing," or processing for targeted advertising under some state privacy laws even when no money is paid for the information. Rights relating to those activities are described below.
8. Payments and Financial Information
Payment functionality is provided through third-party payment services. Those providers may collect payment card, bank-account, identity, business, underwriting, and transaction information directly under their own terms and privacy practices. ProWorx may receive and use payment-related metadata, transaction information, account status, dispute information, and other information reasonably necessary to provide payment functionality, reporting, fraud prevention, support, and compliance. ProWorx does not use payment card numbers or bank-account information as Operational Job Data for cross-customer pricing or model development.
9. Partner Services and Referrals
If you ask ProWorx to connect you with, submit information to, or enable a third-party Partner Service, we may disclose the information reasonably necessary to complete your request. This may include business, contact, transaction, or other relevant information. The third party's collection and use of information is governed by its own terms and privacy practices. ProWorx may receive referral fees, commissions, revenue share, marketing fees, or other compensation as described in our Terms of Service.
10. Cookies, Analytics, and Advertising Measurement
We and our service providers may use cookies, pixels, tags, click identifiers, local storage, and similar technologies to keep the Service secure, remember settings, understand how the Service is used, diagnose problems, measure performance, and evaluate marketing campaigns.
Advertising and conversion-measurement technologies may collect or receive information such as campaign or click identifiers, browser or device information, page visits, referring pages, interaction events, IP-derived general location, and conversion events. Some measurement tools may use first-party cookies or hashed versions of eligible contact information to help attribute a website action to an earlier advertising interaction. Raw contact information need not be disclosed for a provider to perform matching when hashing is used, but the resulting identifier may still be personal information under applicable law.
You can control many cookies through your browser settings. Blocking cookies may affect some features or measurement functionality. Where applicable law gives you a right to opt out of a sale, sharing, targeted advertising, or similar processing, you may exercise that right as described in the "Your Privacy Rights and Choices" section below.
11. SMS/Text Messaging Privacy
If you affirmatively opt in to receive SMS/MMS messages from Blackhawk Catalyst Technology & Consulting, LLC d/b/a ProWorx, we may use your mobile number and messaging-consent information to send account notifications, customer-care messages, appointment reminders, estimate or invoice updates, service updates, support communications, review or feedback requests, and, where separately authorized, marketing or promotional communications.

We do not share, sell, rent, or provide your mobile phone number or messaging consent data to third parties or affiliates for their own marketing or promotional purposes. Mobile information may be disclosed to service providers and telecommunications providers as necessary to deliver, support, secure, or comply with the messaging service.
All other categories of information described in this Privacy Policy exclude text messaging originator opt-in data and consent from disclosure for third-party or affiliate marketing or promotional purposes. SMS consent is specific to the applicable sender and messaging program and is not transferred as permission for an unrelated third party to market to you.
12. Communications Sent by ProWorx Customers
A ProWorx business customer may use the Service to communicate with its own customers or prospective customers. In that situation, the ProWorx customer determines the recipients, content, timing, purpose, and authorization for the communication and is responsible for obtaining legally required consent and honoring opt-out requests. ProWorx processes relevant contact and messaging information to provide the communications functionality. If you receive a communication from a business using ProWorx and have questions about why you received it, please contact that business directly. ProWorx may assist the business with a privacy request where required by applicable law.
13. Data Retention
We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, to provide the Service, maintain business and transaction records, comply with legal or contractual obligations, resolve disputes, prevent fraud or abuse, enforce our agreements, maintain security, and support legitimate business operations.
Retention periods vary based on the type of information and why we process it. After an account ends, access to Customer Data may be limited or the data may be deleted in accordance with our then-current retention practices, subject to legal, backup, dispute, fraud-prevention, tax, payment, processor, partner-provider, and compliance needs. Aggregated or de-identified information that cannot reasonably be linked to an individual may be retained for analytics, research, product development, benchmarking, and service improvement.
14. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. No security measure, system, network, transmission method, or storage environment can be guaranteed to be completely secure. Customers are also responsible for protecting their account credentials, devices, Authorized Users, and their own systems as described in our Terms of Service.
15. Sensitive and Regulated Information
Unless expressly agreed by ProWorx in writing, the Service is not intended to be used as a system of record for protected health information, classified information, full payment-card data outside supported payment rails, or other specially regulated data sets. Customers should not submit sensitive or regulated information to the Service unless they have a lawful basis to do so and the Service is expressly designed or authorized for that use.
16. Your Privacy Rights and Choices
Depending on where you live and which privacy laws apply to ProWorx, you may have rights to request access to personal information, confirm whether we process it, correct inaccurate information, request deletion, obtain a portable copy, or opt out of certain processing such as targeted advertising, qualifying sales or sharing of personal information, or certain profiling. Applicable law may provide exceptions to these rights.
To submit a privacy request, email alex.vaysben@blackhawkcatalyst.com and describe the request. We may need to verify your identity or authority before completing a request. Where applicable law requires an appeal process, you may appeal a denied request by replying to our decision and stating that you wish to appeal.
If ProWorx holds information primarily on behalf of one of our business customers, we may direct you to that business because it controls the relevant customer relationship and privacy choices. We may assist the business in responding where required.
Browser "Do Not Track" signals are not standardized and may not be recognized by all parts of the Service. Where applicable law requires us to recognize a legally valid universal opt-out preference signal, we will process that signal as required by law.
17. Children’s Privacy
ProWorx is a business service and is not directed to children under 13. We do not knowingly collect personal information directly from a child under 13 for the child's own use of ProWorx. If we learn that we collected personal information directly from a child under 13 in circumstances requiring parental consent and without valid consent, we will take reasonable steps to delete or otherwise address the information as required by law. If you believe a child has provided information directly to ProWorx, contact us using the information below.
18. Third-Party Websites and Services
The Service may contain links to, integrate with, or enable use of third-party websites, applications, payment services, review platforms, calendars, maps, financing or insurance providers, partner services, and other third-party services. Their privacy practices are governed by their own policies, not this Privacy Policy. We encourage you to review their policies before providing information directly to them.
19. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to the Service, our information practices, legal requirements, or other operational needs. The updated policy will be posted on this page with a revised effective or last-updated date. Where required by applicable law, we will provide additional notice of material changes.
